What is the purpose of confidentiality in mediation?

Under the Mediation Confidentiality and Privilege Act, mediation is confidential. This means parties cannot share any details with anyone outside of the process.

The purpose is to encourage parties to talk more confidently and honestly without fear of public judgment or a party using their words against them in future legal cases.

According to Florida Courts, the Act applies to all court-ordered mediation and proceedings with a certified mediator. However, there are some exceptions. These include cases like child abuse, elder abuse or anyone stating that they are committing or planning to commit a crime.
